The documents governing the procedures and answer any questions about the procedures and criteria for the assessment of the public interest
The Bureau of Foreign Trade, Ministry of economic affairs (Secex/I), published on Thursday (30/1), the Portaria Secex no. 13/2020governing administrative procedures for the assessment of the public interest in the defence of trade. It was also made available in the final version, and is committed to the Guide in the Interest of Public in the Defense Business.
The new legal act aims to clarify the concerns raised by civil society during the public consultation carried out in 2019, in addition to regulating the points were not set out in the ministerial Decree no. 08/2019, which was in effect until Thursday evening. “It is important to note that the new ordinance continues, with the aim of ensuring that the necessary convergence of the procedural terms of the assessments of the public interest in the investigation of the defense, commercial), both conducted by the Department of Defense, Commercial, and Public Interest (SDCOM) of the Secex,” says the secretary of Commerce, Lucas Foster.
The final version of the Guide, in its turn, it has to update and consolidate into a single document, the guide to the Procedural and Material is in the Public Interest, in the Defense Business, which were published in April 2019. The purpose of the Tab to the Consolidated explain the application process and the criteria for articles to be noted in the assessment of the public interest, as well as a question-and incorporate the suggestions made by the civil society in the course of the public consultation.
The sections of the Guide
The Guide is Consolidated, it is divided into six sections including the Introduction. In section 2, have been carried out for updates about the international experience on the use of the public's interest in the defense business, in particular in the European Union, Canada, and New Zealand.
In section 3, in addition to a review of the relevant legislation and the reasons for that are used for the loved ones as the brazilian government in the assessment of the public interest, have been carried out for updates on the previous occasions, with the presentation of a section of the consolidated data, processes, and decisions are of interest to the public in Brazil. Already, in section 4, it is shown in the final version of the Guide, Procedure, based on the new Portaria Secex no. 13/2020.
Section 5 brings you the final version of the Guide Material, based on criteria that may be taken into account in the decision-making process by the existence or non-existence of elements of interest to the public.
“The criteria for the materials present in the Guide which was published in April of 2019, they remain, at their core, very similar in nature, but have been reorganized to promote more efficient and effective in the presentation of the data by the interested parties, and also in the analysis of the information and / or documents by the SDCOM,” says Lucas Ferraz.
Finally, in section 6, it is presented a new model for the Survey of the Public's Interest in the Defence of Trade.
